GENERAL TERMS AND CONDITIONS (GTC) OF THE DRESDEN PHILHARMONIC for the purchase of tickets, subscriptions, vouchers and merchandise, and attendance at events
I. Scope of Application
(1) These General Terms and Conditions apply to the sale of tickets, subscriptions, merchandise and vouchers for events of the Dresdner Philharmonie and to attendance at events.
(2) In the case of rental events, the Dresdner Philharmonie itself is not the organiser of the events offered. Such events are held by the respective organiser. The Dresdner Philharmonie sells tickets for rental events on behalf of the respective organiser.
II. Sale of Tickets and Vouchers
1. Advance Sales
(1) Customers may purchase/order tickets and vouchers for events of the Dresdner Philharmonie
- at the Ticket Service in the Kulturpalast Dresden, Schloßstraße 2, 01067 Dresden, entrance Wilsdruffer Straße,
- online (Dresdner Philharmonie webshop, www.dresdnerphilharmonie.de),
- by telephone (0351 / 4866 866),
- by post (Dresdner Philharmonie im Kulturpalast Dresden, Schloßstraße 2, 01067 Dresden)
or
- by e-mail (ticket@dresdnerphilharmonie.de)
purchase/order them.
(2) In the Dresdner Philharmonie webshop, tickets may be purchased at the standard price, for pupils under the age of 18 and for eligible young people under the age of 30, severely disabled persons with a disability pass (from a degree of disability (GdB) of 80) and holders of the Dresden Pass. The purchase of other reduced tickets as well as wheelchair and companion seats is possible only through the Dresdner Philharmonie Ticket Service.
(3) Group orders (from 51 tickets) can only be placed in writing (by post or by e-mail).
For tour operators, the separately published "Special Terms and Conditions for Tour Operators" also apply.
(4) For safety reasons, visitors with restricted mobility should order tickets with seats in the stalls and in the 1st balcony in sections H and N (near the doors), as well as in the 2nd balcony in sections R and W (each near the first door).
2. Orders for Tickets, Merchandise and Vouchers by Telephone, Post or E-mail
(1) If the tickets, merchandise or vouchers ordered by the customer by telephone, post or e-mail (order) are available, the customer will receive a reservation confirmation with details of the price, shipping fee, payment method and reservation period. Ordered tickets are generally reserved for the customer for two weeks and held at the Ticket Service for payment and collection. Collection at the event and evening box office is possible only in exceptional cases and only up to 30 minutes before the event begins. Within the reservation period, the order may be cancelled in writing or by telephone.
(2) If the customer requests that the tickets be sent, the customer will first receive an invoice for the ordered tickets. The order will be dispatched only after the invoice has been paid in full.
(3) Tickets/orders not collected or paid for within the reservation period may be released for resale by the Dresdner Philharmonie. The customer has no claim to the tickets/order.
3. Sales at the Event and Evening Box Office
(1) At the event and evening box office, only tickets for the event taking place immediately thereafter are sold.
4. Prices for Tickets and Additional Fees
(1) Tickets for an event are assigned to different price categories. The current ticket prices, including available discounts, can be found on the Dresdner Philharmonie website on the respective event page or obtained from the Ticket Service. The ticket prices published at the time of purchase are decisive.
(2) A maximum of one discount is granted per ticket. Subsequent discounting is excluded.
(3) Holders of the PhilCard1 may claim a discount of 10% on the standard price for up to two tickets per event when booking through the Ticket Service or webshop. The discount does not apply to New Year’s concerts, special concerts, family concerts or organ concerts.
(3) Individual tickets at the standard price, for pupils under the age of 18, eligible young people under the age of 30, severely disabled persons from GdB 80 and holders of the Dresden Pass may be purchased with a FLEX option2.
(4) In addition to the ticket price or merchandise price, the following fees are payable:
- Processing fee for tickets ordered by telephone or in writing for collection at the event box office: €1.50 per ticket
- Fee for tickets with FLEX option: €6.00 per ticket
- Shipping fee for postal delivery:
up to 6 tickets: €2.50 per shipment
up to 15 tickets: €5.00 per shipment
from 16 tickets: €10.00 per shipment
- Issue of duplicate tickets in case of ticket loss: €2.00 per ticket
- Shipping fees for parcels within Germany: €4.50 per parcel
under 1 kg
5. Payment Terms
Depending on the ordering method, the customer may pay for tickets, merchandise and vouchers as follows:
- by EC card/debit card (only on site at the Ticket Service or at the event box office)
- by bank transfer (only for orders by telephone, e-mail or post)
- by credit card (except AMEX) (on site at the Ticket Service or in the webshop)
- by PayPal (only in the webshop)
- with credit on vouchers purchased from the Dresdner Philharmonie
- with customer-account credit (on site at the Ticket Service or in the webshop)
6. Delivery/Transfer of Risk, Ticket Loss
(1) The customer bears the shipping risk when tickets, merchandise or vouchers are sent.
(2) In the event of ticket loss, a duplicate ticket will be issued only if the customer can credibly demonstrate which ticket was purchased. Upon issue of the duplicate, the original ticket becomes invalid. The same applies to the printout of a mobile ticket that had previously been issued as a digital ticket.
7. Programme and Cast Changes
Programme and cast changes are generally reserved. If the change is reasonable for the visitor and does not materially alter the overall character of the event, it does not give rise to any claim to return or exchange tickets. This applies in particular to the replacement of individual performers or changes to individual programme components, provided the overall character of the event is preserved.
8. Event Cancellation and Abandonment
(1) If an event is cancelled, the ticket price will be refunded upon presentation of the ticket.
(2) If an event is abandoned after it has begun, the ticket price will be refunded only if the event is abandoned within the first half hour.
(3) Further expenses incurred by the customer will not be reimbursed.
(4) A refund is excluded in all cases if the cancellation or abandonment of the event concerned was caused by force majeure. Force majeure means the occurrence of an event or circumstance that lies outside the reasonable control of the parties, was not reasonably foreseeable at the time the contract was concluded, and whose effects could not reasonably have been avoided or overcome. The following events are presumed to constitute force majeure: compliance with laws or governmental orders, pandemic, epidemic, natural disaster or extreme natural event, explosion, fire, discovery of an unexploded bomb, destruction, failure or confiscation of technical equipment and facilities, hostilities, insurrection and unrest, war, terrorist acts, sabotage.
9. Transfer and Resale
(1) Individual tickets at the standard price are transferable to other persons. Reduced tickets may be used only by persons who have the corresponding entitlement to the discount.
(2) The resale of tickets is prohibited if it
- is carried out as part of a commercial activity without the prior consent of the Dresdner Philharmonie,
- is carried out without reference to these General Terms and Conditions, or
- is carried out at a price that exceeds the original price of the ticket including fees. Additional mark-ups or fees are not permitted.
Offering or selling tickets in the premises of the Kulturpalast Dresden is not permitted. The Dresdner Philharmonie assumes no responsibility for services provided by third parties that are not offered by the Dresdner Philharmonie as its own services. Any claims must be asserted directly against the respective service provider.
10. Redeeming Vouchers
Vouchers and any remaining credit balances may be redeemed exclusively for events and merchandise of the Dresdner Philharmonie until the end of the third year after purchase of the voucher. There is no claim to payment of the voucher value or any remaining credit balance in cash.
11. Withdrawal from Ticket Orders, Returns and Ticket Exchanges
(1) The customer may not withdraw his/her declaration aimed at concluding the contract, as no right of withdrawal exists pursuant to Section 312g(2) sentence 1 no. 9 of the German Civil Code (BGB). Tickets are therefore excluded from return.
(2) Only tickets purchased with the FLEX option may be exchanged once, up to three working days before the event date, for tickets to another event in the same concert series. The exchange is made
- for tickets purchased online via the customer’s personal access in the webshop (Webshop/Login/My Concerts/Change Date Directly), and
- for tickets purchased through the Ticket Service via the Ticket Service.
When exchanging for a higher price category, the difference must be paid as an additional ticket price. Exchanging for a lower price category does not entitle the customer to payment or credit of the difference. There is no entitlement to exchange tickets. Exchange is possible only subject to ticket availability. There is no entitlement to reimbursement of the ticket price or issue of a voucher.
12. Withdrawal from Voucher and Merchandise Orders
(1) Consumers generally have a statutory right of withdrawal when concluding a distance contract.
(2) Instructions on withdrawal
You have the right to withdraw from this contract, which was concluded using means of distance communication, such as by telephone, letter, e-mail or online form, within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party named by you who is not the carrier has taken possession of the goods. To exercise your right of withdrawal, you must inform us (Dresdner Philharmonie) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. If you make use of this option, we will send you confirmation of receipt of such withdrawal without delay (e.g. by e-mail). To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal:
If you withdraw from the contract, we will refund all payments we have received from you, including processing and shipping fees (except for any additional costs resulting from your choice of a type of shipping other than the inexpensive standard delivery offered by us), without delay and at the latest within 14 days from the day on which we receive notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods/vouchers, whichever is the earlier. You must send back or hand over the goods/vouchers to us without delay and in any event no later than 14 days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods/vouchers before the 14-day period has expired.
You bear the direct costs of returning the goods/vouchers. You are liable for any loss in value of the goods/vouchers only if this loss in value is due to handling that was not necessary for checking the condition, properties and functioning of the goods.
13. Special Infection Situations
In special infection situations and pandemic developments, the Dresdner Philharmonie may stipulate that tickets can be booked only if contact details of the visitor, such as first name, surname, telephone number or e-mail address, are provided. The same applies to the transfer of the ticket to other persons.
III. Sale of Subscriptions
1. Fixed-Seat Subscriptions and Flexible Subscriptions
(1) A fixed-seat subscription within a season entitles the customer to purchase a discounted ticket price/total price for attendance at specified concerts and dates.
(2) A flexible subscription entitles the customer to purchase a discounted ticket price when selecting at least 4 and up to a maximum of 10 concerts, depending on the concert series, within a season. Subject to availability, the seat categories and/or the seat itself may vary when purchasing tickets for the individual concerts. The same number of tickets with the same sales type must be purchased for each concert.
Multiple flexible subscriptions may be booked for one season.
Flexible subscriptions may be offered for the following concert series: symphony concerts, chamber concerts, abgeFRACKt.
(3) The following customer details are required to order subscriptions: first name, surname, address, e-mail address and telephone number. Any changes must be reported to the Dresdner Philharmonie without delay.
(4) A change of subscription and/or seat is possible only for the new concert season, subject to availability and before payment of the invoice.
(5) The Dresdner Philharmonie reserves the right to limit seats in a fixed-seat subscription and/or to change the specified seats for individual concert dates. Reasons may include: blocking of areas for technical equipment, performers or other circumstances.
2. Sale/Order and Payment Terms
(1) The customer may book a fixed-seat subscription or flexible subscription at the Ticket Service or in the webshop, or order it by telephone, post or e-mail.
(2) When ordering by telephone or e-mail, the customer receives an invoice for the selected subscription. Dispatch/deposit of the subscription tickets according to the selected delivery method takes place after receipt of payment.
(3) Depending on the ordering method, the customer may pay for the subscription as follows:
- by bank transfer (on site at the Ticket Service, for orders by telephone or e-mail)
- by credit card (except AMEX in the webshop)
- by EC card/debit card (on site at the Ticket Service)
- by direct debit (exclusively for fixed-seat subscriptions),
- with customer-account credit or vouchers purchased from the Dresdner Philharmonie (on site at the Ticket Service or in the webshop).
3. Term and Renewal
(1) A fixed-seat subscription applies to the respective concert season of the Dresdner Philharmonie and is renewed for one further concert season at a time unless it is cancelled by the customer by 30 March of the current concert season.
(2) The subscription prices and the essential contents of the subscription series for the following concert season will be announced to subscribers before expiry of the cancellation period.
(3) A flexible subscription ends automatically after the last booked concert of the season.
4. Prices for Tickets with Fixed-Seat Subscriptions and Flexible Subscriptions
(1) Prices for fixed-seat subscriptions and flexible subscriptions are set and published separately for each concert season. The subscription discounts applicable for the respective concert season are taken into account.
(2) The price is determined by the price category of the subscribed seat.
(3) If persons entitled to discounts claim discounts in connection with a fixed-seat subscription or flexible subscription, these discounts will be granted only if corresponding proof is provided when the contract is concluded or continued. Any changes in the circumstances giving rise to the discount must be reported to the Dresdner Philharmonie without delay. The Dresdner Philharmonie may require proof of discount entitlement to be provided again. If the requirements for the discount entitlement no longer exist, the customer must pay the difference to the non-reduced price.
5. Delivery/Transfer of Risk, Ticket Loss
(1) The customer bears the shipping risk when tickets are sent.
(2) In the event of loss of a fixed-seat subscription ticket or flexible subscription ticket, a duplicate ticket will be issued. Upon issue of the duplicate, the original ticket becomes invalid. A fee of €2.00 per ticket is payable for the issue of a duplicate.
6. Programme and Cast Changes
Programme and cast changes are reserved and do not give rise to any claim to return or exchange tickets.
7. Transfer and Resale
(1) Fixed-seat subscription tickets and flexible subscription tickets at the standard price are transferable to other persons. Reduced tickets may be used only by other persons with the same discount entitlement.
(2) The resale of fixed-seat subscription tickets and flexible subscription tickets is prohibited if it
- is carried out as part of a commercial activity without the prior consent of the Dresdner Philharmonie,
- is carried out without reference to these General Terms and Conditions, or
- is carried out at a price that exceeds the original price of the ticket including fees. Additional mark-ups or fees are not permitted.

8. Withdrawal, Returns and Exchanges
(1) The customer may not withdraw his/her declaration aimed at concluding the contract, as no right of withdrawal exists pursuant to Section 312g(2) sentence 1 no. 9 of the German Civil Code (BGB). Subscriptions are therefore excluded from return.
(2) Within a fixed-seat subscription, tickets for individual events may be exchanged up to three times for event tickets in the same concert series and price category. When exchanging for a higher price category, the difference must be paid as an additional ticket price. Exchanging for a lower price category does not entitle the customer to payment or credit of the difference. There is no entitlement to exchange tickets; exchange is possible only subject to ticket availability. There is no entitlement to full or partial reimbursement of the ticket price or issue of a voucher.
IV. Attending Events
1. Admission
(1) The ticket entitles the holder to one-time attendance at the event stated on the ticket. Programmes, parking fees and other services that do not directly belong to the event concerned are not included. Each ticket entitles only one person to attend the event.
(2) The ticket must be presented at the entrance without being requested. For reduced tickets, proof of discount entitlement must also be presented. Otherwise there is no entitlement to attend the event. The ticket price will not be refunded.
(3) If, due to statutory or official requirements, an event may be attended only with proof of vaccination, recovery, testing or comparable proof, this must be presented upon request. If required proof cannot be provided, there is no entitlement to admission to the event. In this case, there is no entitlement to reimbursement of the ticket price.
(4) After the event has begun, there is no entitlement to immediate admission. Late admission may be restricted in time for reasons of maintaining an undisturbed event and takes place solely in accordance with the instructions of the service staff. Reseating may occur. After the event has begun, there is no entitlement to the seat shown on the ticket.
2. Seats and Wheelchair Spaces
(1) The visitor may occupy only the seat shown on his/her ticket or assigned to him/her by service staff.
(2) Separately designated wheelchair spaces and seats for accompanying persons are available for wheelchair users and their accompanying persons.
(3) Reseating may occur if this is necessary for organisational, artistic, safety-related or accessibility-related reasons.
3. Cloakroom, Walkers, Food and Drinks
(1) Coats, thick jackets, umbrellas, backpacks, walking sticks (except walking aids), large luggage, bags from A4 size upwards and bulky items, as well as animals (except service/assistance dogs, with prior registration), may not be taken into the concert hall.
(2) Cloakroom items may be handed in to the cloakroom staff free of charge for the duration of the event. When handing in cloakroom items, the visitor receives a cloakroom token. Upon presentation of the cloakroom token, the handed-in cloakroom items will be returned without checking entitlement. If the cloakroom token is lost, the visitor must pay an additional fee of €5.00 (payable by EC card/debit card or credit card).
(3) After cloakroom items have been returned, the visitor must report missing or damaged cloakroom items without delay.
(4) After the visitor has been seated, walkers must be handed over to service staff. During the event, walkers may not remain in the hall and will be placed outside the hall by service staff. During the interval(s) and at the end of the event, the walker will be returned to the visitor at his/her seat.
(5) Bringing food and drinks into the hall and consuming them there is not permitted.
4. Mobile Phones, Image and Sound Recordings
(1) Mobile phones and other electronic communication and information devices, as well as acoustic signalling devices of any kind, must be kept switched off in the hall. In the event of non-compliance, the visitor is obliged, upon request by service staff, to hand over the relevant communication or information device to service staff for the duration of the event and/or to leave the hall. This does not apply to events at which mobile phones are expressly permitted (e.g. “abgefrackt”) or where such communication devices are necessary for surveys or other data collection/evaluation purposes. The following provisions remain unaffected.
(2) During the event, image and sound recordings of any kind by the visitor are generally prohibited. In the event of non-compliance, the visitor is obliged, upon request by service staff, to delete the recording or tolerate deletion by service staff and/or to leave the hall for the duration of the event.
(3) By attending the event, the visitor agrees that, in the case of image and/or sound recordings of the event for TV, internet or print media made by or on behalf of the Dresdner Philharmonie, recordings made of him/her may be broadcast or published without any entitlement to remuneration.
5. Lost Property and Loss of Items
(1) Items of any kind found during the event must be handed over to service staff without delay.
(2) The loss of items must be reported to service staff without delay.
(3) Lost property should be enquired about with the service staff of the event concerned or, after leaving the Kulturpalast, with the security desk at the Kulturpalast Dresden.
6. Dangerous Situations
In the event of fire or other dangerous situations, visitors must leave the venue without detours, including without first collecting cloakroom items, immediately through the marked exits and emergency exits to the assembly point in front of the Kulturpalast Dresden. The instructions of service staff must be followed.
7. House Rules
(1) The house rules of the Kulturpalast Dresden must be observed. Smoking is prohibited. The house rules are displayed on the pillars in the entrance areas on the ground floor of the Kulturpalast Dresden and can be viewed on the Kulturpalast Dresden website (https://www.kulturpalast-dresden.de/de/hausordnung/).
(2) The Dresdner Philharmonie exercises the right to enforce house rules at its events in the respective venue. For this purpose, it may make use of vicarious agents, in particular service staff. The instructions of service staff must be followed.
(3) The private offering and resale of tickets in the Kulturpalast Dresden is prohibited.
(4) Visitors may in particular be expelled from the premises in the following cases:
- disruption of the event concerned,
- harassment of other visitors,
- obstruction or disruption of ticket sales, or
- other breaches of the rules on attending events or of the house rules of the Kulturpalast Dresden.
(5) Admission to the Kulturpalast Dresden may be refused to visitors who have repeatedly breached the visitor rules.
(6) Such visitors have no claim to reimbursement of the ticket price or to any other compensation for damages or expenses.
V. General Provisions
1. Liability and Exclusion of Liability
(1) The Dresdner Philharmonie is fully liable for damages based on injury to life, body or health. The Dresdner Philharmonie is likewise liable without limitation for the breach of essential contractual obligations (cardinal obligations). In all other respects, the liability of the Dresdner Philharmonie is limited to intent and gross negligence.
(2) To the extent that the liability of the Dresdner Philharmonie is excluded or limited under the preceding paragraph, this also applies to the liability of its vicarious agents and assistants.
(3) No guarantee is assumed for information in publications of the Dresdner Philharmonie. The current concert programmes with start times are announced at the Dresdner Philharmonie Ticket Service and on the website. Changes are reserved.
2. Data Protection
The data collected in connection with orders for tickets and subscriptions and with attendance at events are collected, processed and used in accordance with the applicable data protection provisions for the purposes of processing the order, delivering the ordered tickets and vouchers, processing payment and holding the event. The processing of personal data takes place in accordance with the privacy notices of the Dresdner Philharmonie. These are available at https://dresdnerphilharmonie.de/de/datenschutz/.
3. Amendments to the General Terms and Conditions
Amendments to the General Terms and Conditions will be communicated to the customer no later than two months before their planned effective date. The proposed amendments generally become effective only if the customer agrees to them.
By way of derogation from this, the customer’s silence is deemed consent if the amendment serves exclusively to adapt the General Terms and Conditions to changed statutory requirements, official orders or supreme-court case law, the customer has been expressly informed of this consequence in the amendment offer, and the customer has not rejected the amendment offer before the proposed effective date.
4. Final Provisions
(1) The law of the Federal Republic of Germany applies exclusively.
(2) The sole place of performance for delivery, services and payment is Dresden, provided the customer is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB).
(3) The Dresdner Philharmonie is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
